1. Which Trademark Registry office handles Pune-based applications?
Pune-based trademark applications are handled by the Trademark Registry, Mumbai — officially located at IP Bhavan, Antop Hill, S.M. Road, Mumbai – 400 037. Maharashtra falls under the Mumbai Registry’s jurisdiction. That said, since 2017, the entire trademark filing process is 100% online via the IP India portal (ipindia.gov.in). You never need to physically visit any Registry office for a standard filing or routine prosecution.
The only time physical attendance at the Mumbai Registry may be required is in the event of an oral hearing before the Hearing Officer — and even these are now routinely conducted via video conference. Our agents represent clients at these hearings without requiring your personal presence.
2. How long does trademark registration take in Pune? Is there a fast-track option?
The standard timeline from filing to certificate, assuming no objections or oppositions, is approximately 20–24 months. Here is how that breaks down: Examination takes 16–18 months; if an objection reply is needed, add another 2–4 months; Advertisement runs for 4 months; and issuance of the certificate after the advertisement period adds another 1–3 months.
For businesses with genuine urgency, the Trademark Registry accepts applications for expedited examination (Form TM-M, with an additional fee), which reduces the examination wait from 6 months to as little as 1 month in current processing conditions. We advise expedited filing for businesses heading into funding rounds, franchise launches, or export markets.
Remember: your legal protection and right to use ™ begins on the filing date, not the registration date. So day one of filing is already day one of brand protection.
3. What happens if my trademark application receives an objection in Pune?
Receiving an Examination Report (objection) is not unusual — in fact, approximately 40–60% of trademark applications in India receive some form of examination observation. It does not mean your application will fail. It means the examiner has raised questions that need to be addressed.
The most common objections in India are: (a) the mark being descriptive or laudatory; (b) the mark being deceptively similar to an already-registered or pending mark; (c) the specification of goods/services needing clarification. You have 30 days to submit a response to the Examination Report. If the response is satisfactory, the Registrar accepts the mark. If not, a hearing is scheduled before a Hearing Officer — which our agents attend on your behalf.
Our objection reply success rate is exceptionally high because we draft legal arguments, not template responses. We cite precedents from the IP India database and, where appropriate, from High Court intellectual property judgments. An unanswered or poorly drafted reply is the only way to truly lose at this stage.
4. Can I register a trademark in Pune if I am a freelancer or sole proprietor?
Absolutely. Individual applicants and sole proprietors can file trademark applications in their personal name — no company registration is required. This is actually one of the simplest filing categories. The government fee is ₹4,500 per class (same as MSME entities). Freelance consultants, independent designers, personal finance advisors, and individual content creators in Pune frequently trademark their personal brand names or professional aliases.
The only thing to consider is future assignment: if you later form a company and want the trademark to be owned by the company, you will need to file a Trademark Assignment (Form TM-P). We handle these transfers routinely. Many founders intentionally file as individuals first and assign to the company once it is incorporated — there is nothing legally wrong with this approach.
5. Does a trademark registered in Pune protect my brand across all of India?
Yes — completely. India operates a single national trademark register. A trademark registered by a Pune business is valid and enforceable in Delhi, Chennai, Bengaluru, Kolkata, and every other city and state of India. There is no such thing as a “Pune trademark” or a “Maharashtra-only trademark.” Your registration grants you exclusive rights across the entire territory of India within the registered class(es).
This also means that if a business in another state tries to use your registered mark, you can take legal action against them in their local court or before the IP Appellate Board — without needing to litigate in Pune. Trademark infringement is a cognizable offence under Section 103 of the Trade Marks Act, 1999, and the police can be involved in serious cases of counterfeiting.
6. Can two different businesses in Pune have the same trademark name?
Yes — but only if they are in completely different and unrelated classes. The trademark system is class-based. “Apple” the computer company (Class 9) and “Apple” a garments brand (Class 25) can theoretically co-exist, though in practice, well-known marks can block this due to the “dilution” doctrine. However, for most SME brands, if your competitor is in an unrelated industry and a different class, the same name can co-exist legally.
The risk arises when classes are adjacent or overlapping. A “Bolt” brand in Class 9 (software) and a “Bolt” brand in Class 42 (software services) would very likely be considered deceptively similar and create infringement issues. This is exactly why class selection — and a comprehensive multi-class search before filing — is so critical. We map out these adjacency risks in every search we conduct.
7. What is the TM-A form and do I need to fill it myself?
Form TM-A is the official trademark application form prescribed under Rule 23 of the Trade Marks Rules, 2017. It requires you to declare the applicant’s details, the nature of the mark, the class, the specification of goods/services, and the basis of claiming the mark (proposed use vs. prior use). It is submitted online on the IP India portal.
You do not need to fill it yourself. As your registered trademark agent, we fill out and submit Form TM-A on your behalf using the Power of Attorney you provide. We ensure that the specification of goods/services is drafted accurately (this is a legal document — vague or over-broad specifications are routinely objected to), the correct drawing code is assigned for logo marks, and the priority claim is correctly stated if applicable. Correct drafting of the specification is arguably the most important skill in the entire filing process — it determines the breadth of your protection.
8. Can I track my trademark application status online?
Yes. The IP India portal has a public search interface at tmrsearch.ipindia.gov.in where you can enter your application number to see the current status. Common statuses include: “Formalities Check Pass” (application acknowledged), “Marked for Exam” (queued for examination), “Examination Report Issued,” “Accepted,” “Advertised,” “Opposed,” “Registered.”
As our client, you do not need to monitor this yourself. We check the status of every client application weekly and notify you of any change via email. We have caught Examination Reports that clients would have missed if monitoring themselves — and we have responded well within the 30-day deadline every single time.
9. What happens if someone opposes my trademark application in Pune?
When your trademark is advertised in the Trademark Journal, any person can file a Notice of Opposition (Form TM-O) within 4 months of advertisement, along with the applicable government fee. Common grounds for opposition include: the marks being deceptively similar, prior use by the opponent, or the mark being descriptive.
If an opposition is filed, the proceedings follow a structured format: (1) You receive the Notice of Opposition and must file a Counter Statement (Form TM-O) within 2 months. (2) Both parties file Evidence by way of Affidavit. (3) Oral hearings are conducted before the Hearing Officer at the Registry. (4) The Hearing Officer passes an order — either allowing the opposition (application rejected) or dismissing it (application proceeds to registration).

10. Is Pune's address required on the trademark application?
No — a Pune address is not required to file a trademark application for a Pune business. What matters is the applicant’s principal place of business, which determines which Registry office has jurisdiction. For Pune businesses, this is the Mumbai Registry. But the address on the application can be any valid business or residential address of the applicant — it does not have to be a Pune address specifically.
For applicants who do not have an established business address, a registered trademark agent’s address can serve as the address for service (for correspondence purposes only). This is a practical option for home-based businesses or micro-enterprises that operate from a residential address but prefer not to list it publicly on the IP India database.
11. Can I use ™ on my products and website right after filing?
Yes — you may use the ™ symbol as soon as your trademark application is filed. There is no waiting period. The ™ symbol indicates that you have a pending trademark application and are claiming the mark — it does not imply the mark is registered. You can use ™ on your product packaging, website, marketing materials, business cards, and social media handles from the day you receive your application number.
Only once you receive the Trademark Registration Certificate — which comes after the full examination, advertisement, and registration process is complete — can you switch from ™ to ®. Make a note of the certificate receipt date and update your branding materials accordingly. We remind all our clients of this transition point when the certificate is issued.
12. Can I register a trademark for a name that I have already been using for years?
Not only can you — you should file with a “Prior Use” basis, which actually strengthens your application significantly. If your mark has been in use in India prior to a conflicting pending application filed by a third party, your date of first use becomes critical evidence. Under Section 12 of the Trade Marks Act, 1999, the Registry may register two similar marks if there is a history of honest concurrent use.
When filing on prior use basis, we collect and submit evidence: earliest invoices bearing the mark, product photographs, advertising materials, GST filings, website archives, social media posts with timestamps. The stronger and older your evidence of use, the stronger your application. We have successfully used prior-use arguments to displace pending applications filed by third parties — even when those parties technically filed first but used the mark later.
