The ™ (TM) symbol can be used from the moment you receive your trademark application number — no registration certificate is needed. It signals that you are claiming trademark rights over the mark and have a pending application. The ® (Registered) symbol can only be used after you receive the official registration certificate from the Trademark Registry. Using the ® symbol without a completed registration is a criminal offence under Section 107 of the Trade Marks Act, 1999, punishable with imprisonment up to 3 years and/or fine. We always advise clients to use ™ from Day 1 of filing and upgrade to ® only upon receiving the registration certificate.
7. Do I need a separate trademark for my Noida or Gurugram office?
No. Trademark registration in India is national — one registration protects your brand across the entire country, including all NCR cities. Noida (UP) and Gurugram (Haryana) both fall under the Delhi Trademark Registry’s jurisdiction anyway. There is no concept of a “city-level” or “state-level” trademark in India. A single properly filed trademark covers your brand’s exclusive use for the specified goods/services everywhere in India.
8. How do I check my trademark status on the IP India portal?
Visit ipindia.gov.in → Trade Marks → Trademark Status (or use the public search). Enter your application number to view the current status. The portal is updated regularly by the Registry. Key statuses and their meanings: “Formality Check Pass” (documents verified, queued for examination) → “Sent for Examination” (with an examiner) → “Examination Report Issued” (objection raised — act within 30 days) → “Accepted and Advertised” (published in journal, 4-month opposition window) → “Registered” (complete). 9. Can a partnership firm or Hindu Undivided Family (HUF) register a trademark in Delhi?
Yes. Under the Trade Marks Act, 1999, a wide range of entities can apply for trademark registration in Delhi, including: Individuals, Sole Proprietors, Partnership Firms (all partners as joint applicants), Companies (Pvt. Ltd. / Ltd.), Limited Liability Partnerships (LLPs), Trusts, Societies, Hindu Undivided Families (HUFs), Government bodies, and Foreign nationals/entities. For HUFs, the application is typically filed in the name of the Karta (head of family) “on behalf of” the HUF. For partnerships, all partners are named as co-applicants. 10. How long is a trademark valid and what happens when it expires?
A registered trademark in India is valid for 10 years from the date of the original filing (not from the date of registration). It can be renewed indefinitely for successive 10-year periods by filing Form TM-R and paying the renewal fee. The renewal application can be filed up to 6 months before the expiry date. If you miss the renewal deadline, you have a 6-month grace period to renew with an additional surcharge. After this grace period, the trademark is removed from the Register. A removed trademark can potentially be restored within 1 year of removal by applying to the Registrar, but this is an expensive and uncertain process. 11. What is a "well-known trademark" and does it offer better protection?
A “well-known trademark” is a mark that is widely recognised among a significant section of the Indian public as identifying specific goods/services from a specific origin — irrespective of whether it is registered in India. Under Section 11(6)–11(10) of the Trade Marks Act, 1999, a well-known trademark gets cross-class protection — meaning no one can register a similar mark even for completely different goods or services. The Trademark Registry maintains an official list of well-known marks in India. Brands like TATA, Amul, Reliance, and Infosys have well-known status. Most Delhi businesses are not in this category, but building towards it through consistent use and multiple trademark registrations is a sound long-term brand strategy.
12. Can I register my brand name in multiple trademark classes to cover all business activities?
Yes, and this is a common strategy for growing businesses. You can file separate applications (each with its own fee) for the same mark in multiple classes. For example, a fashion brand might register in Class 25 (clothing), Class 35 (retail services), and Class 18 (leather accessories) simultaneously. All three applications are filed separately, each with its own application number and examination timeline, but they are linked by the same proprietor name.
